TERMS OF USE

These Terms of Use (“Terms”) are a binding agreement between you (“you” or “Patient”) and Spicerack Health (“Spicerack Health,” “we,” “us,” or “our”).

These Terms govern your access to:

  • Our website www.spicerackhealth.com (the “Site”)
  • Telehealth nutrition counseling services
  • Secure messaging
  • Scheduling tools
  • Educational materials
  • Insurance-related administrative services
    (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms.

Eligibility

Services are available only to:

  • Individuals 18 years of age or older
  • Individuals physically located in the State of Illinois at the time services are rendered

By scheduling or attending an appointment, you represent that you are physically located in Illinois during the visit.

Scope of Dietitian Services

Spicerack Health provides Medical Nutrition Therapy (MNT) and related nutrition services through a Registered Dietitian licensed in Illinois.

Services may include:

  • Nutrition assessment
  • Medical nutrition therapy
  • Dietary counseling
  • Chronic disease nutrition support
  • Preventive nutrition care
  • Follow-up monitoring

Not a Substitute for Physician Care

  • We do not provide physician services.
  • We do not prescribe medications.
  • We do not provide emergency medical treatment.

You are responsible for maintaining a relationship with a primary care provider or other appropriate healthcare professionals.

Telehealth Services

All services are delivered via telehealth technologies in accordance with state law.

By using the Services, you:

  • Consent to receiving care via telehealth
  • Understand that telehealth may have limitations compared to in-person care
  • Acknowledge potential technology disruptions
  • Understand that you may withdraw consent to telehealth at any time

You agree to:

  • Provide your physical location at the time of each session
  • Ensure you are in a private setting suitable for healthcare services

If you are experiencing a medical emergency, call 911 immediately.

Insurance Billing and Financial Responsibility

Spicerack Health may bill your health insurance plan for covered services.

By receiving Services, you:

  • Authorize us to bill your insurance on your behalf
  • Assign benefits directly to Spicerack Health
  • Authorize release of necessary medical information to your insurer for claims processing

Your Financial Responsibility

You understand that:

  • Insurance coverage is not guaranteed
  • You are responsible for copays, deductibles, coinsurance, and non-covered services
  • If your insurance denies a claim, you remain financially responsible

If you are uninsured or self-pay for certain services, you may be entitled to a Good Faith Estimate under the No Surprises Act.

HIPAA and Protected Health Information (PHI)

Spicerack Health complies with the Health Insurance Portability and Accountability Act (HIPAA).

Your Protected Health Information (PHI):

  • Is used and disclosed only as permitted by law
  • Is protected through administrative, physical, and technical safeguards

A separate Notice of Privacy Practices governs your healthcare information and is incorporated by reference.

Account Security

If you use a patient portal:

  • You are responsible for maintaining login confidentiality
  • You must notify us of unauthorized access
  • We may suspend access for security concerns

Intellectual Property

All educational materials, meal frameworks, tools, branding, and content on the Site are owned by Spicerack Health.

You may not copy, distribute, or commercially exploit materials without written permission.

Disclaimer of Warranties

Services are provided “as is” and “as available.”

We do not guarantee:

  • Specific weight loss
  • Improvement in lab values
  • Disease remission
  • Any particular health outcome

Individual results vary.

Limitation of Liability

To the fullest extent permitted by Illinois law:

Spicerack Health shall not be liable for indirect, incidental, or consequential damages arising from use of the Services.

Our total aggregate liability shall not exceed the greater of:

  • $100, or
  • The total amount paid by you in the preceding 12 months.

Nothing in these Terms limits liability that cannot legally be excluded.

Governing Law

These Terms are governed by the laws of the State of Illinois.

Venue for disputes not subject to arbitration shall lie in Illinois courts.
